Terms and Conditions

In these terms and conditions, the following definitions apply:

Montung: the trade name of BB-Import VOF, the seller using these terms.
Consumer: the natural person who is not acting for purposes related to a trade, business or profession and enters into an agreement with Montung.
Agreement: the purchase agreement between Montung and the consumer, including orders placed via the webshop, by email, WhatsApp or on location.
Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
Right of withdrawal: the consumer’s right to withdraw from a distance contract within the cooling-off period.
Product: a natural stone pot, trough, jar, vase or related item from Montung’s range.

Montung is the trade name of BB-Import VOF, registered with the Dutch Chamber of Commerce (KvK) under number 93462158.

Visits and pick-up are possible by appointment in Zuidoostbeemster (Noord-Holland, the Netherlands).

These terms and conditions apply to every offer made by Montung and to every agreement concluded between Montung and the consumer.

Before the agreement is concluded, the text of these terms is made available to the consumer. The consumer can read and save these terms at any time via this page.

Our pots are authentic, handmade natural products that are personally sourced. Each piece is unique. Differences in colour, shape, size, texture and degree of weathering are inherent to the product and are explicitly not a defect.

Photos, dimensions and descriptions represent the product as accurately as possible, but are indicative. Natural stone may temporarily appear darker or slightly green in rain, damp conditions or during autumn. This fades again in dry weather or after cleaning, and is not grounds for withdrawal or a refund.

The agreement is concluded the moment the consumer accepts the offer and meets the associated conditions, for example by completing an order in the webshop or paying a deposit.

Because each pot is unique and exists only once, Montung may reserve a product for the consumer after a (deposit) payment. Montung confirms the order by email.

All prices are in euros and include VAT. Delivery costs are calculated separately based on weight, volume and distance, and are shown before the order is finalised. Pick-up is free.

Payment can be made in full or, where offered, via a deposit with the remaining balance due later. Payment is processed through our payment provider (Mollie). With a deposit, we reserve the pot; you pay the remaining balance before or upon delivery or pick-up, unless agreed otherwise.

Due to the weight and value of our pots, we prefer to deliver and place them ourselves, or have them delivered by a specialised courier. Pick-up by appointment is always possible.

The risk of damage to or loss of the product passes to the consumer at the moment the product is delivered and received, or picked up.

Upon delivery or pick-up, we check the condition of the pot together. The recipient signs for receipt with the following statement:

“The recipient hereby declares to have received the product in good, complete and undamaged condition. Any later transport damage can no longer be claimed.”

For a distance purchase, the consumer has the right to withdraw from the agreement within 14 days of receiving the product, without giving any reason (the cooling-off period).

Want to withdraw? Notify us within the cooling-off period with an unambiguous statement, by email to info@montung.nl. You then return the product within 14 days.

The consumer is responsible for the return shipment and bears all costs involved. Due to their weight and size, our pots cannot be returned via regular post (such as PostNL). The pot must be placed on a pallet and sent via specialised transport. The cost of this transport is estimated at between €70 and €250, depending on size and distance. The consumer arranges and pays the carrier directly; Montung does not advance these costs.

During the cooling-off period, the consumer handles the product and its packaging with care. The consumer is liable for any depreciation of the product resulting from handling beyond what is necessary to establish the nature and characteristics of the product.

Returns are only possible if the pot is received back undamaged and complete. If the pot arrives damaged, broken or scratched, the depreciation is deducted and we will not refund the purchase price, or not in full.

Montung refunds the purchase price (minus any depreciation) within 14 days of the withdrawal. We may withhold the refund until we have received the product back undamaged, or until the consumer has demonstrated that the product has been returned.

The right of withdrawal does not apply to products made or adapted to the consumer’s specifications, for example a pot or trough converted into a fountain on request.

Montung warrants that the product complies with the agreement and with the reasonable expectations the consumer may have of an authentic, weathered natural product. The characteristics referred to in article 4 (unique colour, shape, texture and weathering) explicitly fall within those expectations and do not constitute a defect.

In the event of force majeure, Montung is not obliged to fulfil the agreement. Force majeure includes, among other things: transport disruptions, extreme weather conditions and other circumstances beyond Montung’s control. In such cases, we will contact you promptly to find a suitable solution.

Do you have a complaint about a product or our service? Please contact us within a reasonable time via info@montung.nl. We respond as quickly as possible and work together to find a solution.

Dutch law applies to all agreements with Montung. If we are unable to reach an agreement together, the dispute may be submitted to the competent Dutch court.

Montung may change these terms and conditions. The version that applied at the time the agreement was concluded always applies to an order.
